While some people may find benefits for some of the conditions listed above, others will not. CBD and THC are both found in cannabis plants, but they interact with your body differently. The Substance Abuse and Mental Health Services Administration, the agency overseeing the Federal Drug-Free Workplace Program, provides additional information regarding the federal policy for testing and use of these products. CBD oil is commonly mixed into massage oils, lotions, balms, makeup, skin and hair products or incorporated into food such as baked goods, gummies, beverages, and a widening array of goods. 227.[142]Drafters planned to submit a petition to the Controlled Substances Board in early 2012.

In addition, demonstrating an effect in an animal model of a disease or disorder is only one of the initial steps in drug development. Many drug candidates that show promise preclinically are not effective in humans and/or have unacceptable adverse effects (Henderson, Kimmelman, Fergusson, Grimshaw, & Hackam, 2013; Pound & Ritskes-Hoitinga, 2018). Today’s actions come as the FDA continues to explore potential pathways for various types of CBD products to be lawfully marketed. This includes ongoing work to obtain and evaluate information to address outstanding questions related to the safety of CBD products, while maintaining the agency’s rigorous public health standards.
- Research shows CBD can elevate the body’s self-made endocannabinoids, and scientists are also hunting for a “hidden” brain receptor for the cannabis extract.
- There’s even a small pistil — called a preflower — on young plants that allows horticulturists to identify females without a genetic test.
- The recreational use of cannabis has been legalized in 24 states, three U.S. territories, and D.C.[b] Another seven states have decriminalized its use.[c][8] Commercial distribution has been legalized in all jurisdictions where possession has been legalized, except for Virginia and D.C.

- In the early 20th century, many Mexicans immigrated to the United States due to the Mexican Revolution.
Marijuana Law, Policy, and Authority
CBD, or cannabidiol, is the second most prevalent active ingredient in cannabis (marijuana). While CBD is an essential component of medical marijuana, it is derived directly from the hemp plant, a cousin of marijuana, or manufactured in a laboratory. One of hundreds of components in marijuana, CBD does not cause a high by itself. In addition, under 21 CFR 530.20, extralabel use of an approved human drug in a food-producing animal is not permitted if an animal drug approved for use in food-producing animals can be used in an extralabel manner for the use.
- In explaining its December decision, the DEA characterized the rule as bringing U.S. marijuana enforcement into better compliance with international drug control regulations—under the United Nations Single Convention on Narcotic Drugs, marijuana and its extracts are tracked separately.
- A 2018 World Health Organization report called CBD “generally well-tolerated, with a good safety profile.” It also found that CBD was not addictive.
- But a cannabis plant is an exception, in that it is almost always either female OR male.
Adverse Effects of THC- or CBD-Containing Products
Hemp-derived CBD products (with less than 0.3 percent THC) are legal on the federal level, but are still illegal under some state laws. Marijuana-derived CBD products are illegal on the federal level, but are legal under some state laws. Keep in mind that nonprescription CBD products are not FDA-approved, and may be inaccurately labeled.
Hemp vs. Marijuana: What’s the Difference?
At the state level, laws regarding CBD use vary, though, with some making use fully legal and others putting restrictions on it. Still, experts say prosecution is unlikely as long as users don’t buy CBD products that also contain levels of THC that exceed the federal limit. “You’re not going to face legal action for buying CBD products if you don’t break the federal law,” says Koturbash. The medication Epidiolex — the only CBD-based treatment approved by the U.S. Food and Drug Administration (FDA) — has been proven effective for severe seizure disorders. A twice-daily oral solution, Epidiolex has been shown to be effective in a number of clinical trials, including a 2021 study that found a median decrease in certain seizures ranging from nearly 50% to over 70%.
Is CBD Legal Under Federal Law?
In addition, they address violations relating to the addition of CBD to food, and the impermissible marketing of CBD products as dietary supplements. Two of the letters also address CBD products illegally marketed for pets, including a product for use in the eye. Given the diverse scope of these products, CBD may be described by product marketers as a dietary supplement, a food additive, a cosmetic ingredient, is cannabidiol addictive or a drug, each of which would be regulated differently by the FDA. A drug undergoes a rigorous FDA approval process, with required demonstration of its relative safety and efficacy for the treatment of condition(s) for which it is approved. CBD went through this process in 2018 when it was approved as a drug for severe pediatric epilepsy and is currently undergoing clinical trials for other conditions.
